My employer applied for a new H1B for this year and luckily it got approved and my interview is scheduled for next week.
My petition has the work location as Stamford , CT but recently the client moved to Shelton, CT.
As both the cities are within same MSA and county, employer said no amendment is needed and just a re-posting of my current LCA is required.
Question : As petition has Stamford as my current work location but now I will be working from Shelton what should I answer if asked for the work location in my interview?
Please help so that I can clear my head before my interview next week!
You will have to tell the truth. Stating a work location where you are not going to be, may land you in trouble in future. If the officer asks why is it different on your petition, state the truth that your client moved and employer said that nothing needs to be done if it is within the same MSA.
Below is the rule on USCIS website:
A move within an MSA: If your H-1B employee is moving to a new job location within the same MSA or area of intended employment a new LCA is not required. Therefore, you do not need to file an amended H-1B petition. However, you must still post the original LCA in the new work location within the same MSA or area of intended employment. For example, an H-1B employee moving to a new job location within the New York City MSA (NYC) would not trigger the need for a new LCA, but you would still need to post the previously obtained LCA at the new work location. This is required regardless of whether an entire office moved from one location to another within NYC or if just one H-1B employee moves from one client site to another within NYC.
