Will I still be considered under 20,000 Cap?

Hi All,

I will appreciate if you could answer my questions.

I am graduated from US university in 2005 and got H1B under 20,000 cap (I believe) but after few months I returned back to India. I do not know what is the status of my H1B till now. Has it been cancelled or not?

Can I apply for new H1B? If Yes, will my case be considered under 20,000 cap?

Usually the person is cap-exempted for 6 years but some folks have got approvals recently when this 6 year rule was relaxed.

So if you have an employer willing to file H-1, then talk to them and their attorney about it. You would need at least the receipt number of previous H-1 petition for this.
