H1B Amendment and LCA change

Hi Suarabh & Team

  1. I have got my i797B petition approved with a company for client X in one location, if i need to go to another location for client Y for the same company ? do they need to file LCA for client Y and H1B amendement? Please let me know.

  2. If i change the company itself from X to another one Y ? does company Y need to file LCA again?

  3. The issue is i have not yet gone for stamping for client X and company X. Please help

  1. Yes, LCA + H-1 amendment is required

  2. Yes, LCA + H-1 cap-exempt petition (aka H-1 transfer)

  3. Doesn’t matter. You can appear for stamping at any stage as long as you have a correct approved petition from the sponsoring employer.
