H1B approved but COS denied

Hi All,

I have my H1B petition approved from H4 but the change of status been denied due to my traveling to Indian for family emergency. Now I am in the USA with the approved petition and need to go for visa stamping. Kindly let me know if I have any specific period from the time of approval as I can go for it only by end of Nov due to personal circumstances. So please do reply and let me know.

Thanks
Prabhakar

It shouldn’t be a problem. You may take appointment at an US consulate for the stamping.

P.S. This is not a legal advice.

Thanks a lot for your reply. Yes thats what I found out discussing with friends around here. However, your reply also gives me more clarity. Thanks again!

Also, I would like to know if its mandatory to go to the home country for stamping or is it ok to visit Canada / Jamaica or Mexico as well for first time stamping?

You may try your luck visiting Canada; Mexico - not possible. You may do your research for Jamaica. But best bet is always your home country.

Thanks for your reply. Just for the knowledge - Can you please let me know why Mexico is not possible? Yes I agree the best option is the home country!!

They don’t do it any more. Search in google.

Ohhh really!!! Thanks. Anyways I guess ppl wouldn’t suggest/prefer Mexico due to security reasons thats what I hear. But thanks for this info. You’ve been really helpful!!

@All tried to help me - I went for a visa stamping on 18th Dec and it went smooth & got the stamping done successfully with god’s grace. Thanks for your help!!
