H1B Transfer Process - Is Paystubs are really important ?

Dear All,

I have a valid H1 approved & stamped for period - OCT '14 to SEP '17 & planning to travel USA by Jan 15.

In the meantime, Can I look for any openings with the US company directly from India. I understand another employer can do H1 file exempt and transfer the Visa.

In this process,

  1. Does Paystubs are mandatory in the visa transfer process? Pay stubs are required for Employer or it is a mandate for USCIS

  2. Do I need to go for Stamping again (assume H1 transfer is approved) ?

  3. If Stamping is not required, Do I face any problem in Point of Entry ?

Hi Shiny,

I have known many cases where paystubs were not required for the transfer. You don’t need to go for stamping again, what you have is a valid travel document once the transfer is approved. At point of entry, there would only be a problem sometimes if you were to travel without a project from first company and also without a transfer. This is not the case here.
