L1B-Visa extension - I-94 extension

I have one more query regarding my husband's I-94 extension.

Can he visit India before Dec 29 2012 so that he might get a new I 94 when he comes back to US. Will this be valid even if the I-94 extension request which his company makes gets rejected?
