H1B Petition approved in 2008 from previous employer but never stamped.

MY VISA STATUS:-

1. I have valid B1 Visa from previous employer (employer A) and never entered US on B1 Visa.



2. H1B petition approved in 2008 from previous employer (employer A) but never went for stamping.



3. I never entered US on B1 or H1



3. Currently I am working for employer B and planning to do stamping based on H1B petition approved in 2008.



[b]CLARIFICATIONS:-[/b]



1. My H1B petition approved in 2008 is still valid for stamping from employer B?



2. If it’s not valid, do I need to file new H1B petition? and is it required to process through lottery system?



3. How many days new H1B petition will take for stamping? Or is new H1B petition is processed with ref to 2008 petition approved?



Please clarify.
  1. No, Cap-Exemption must be filed and approved

  2. Cap-Exemption can be done, U dont need to go thru Lottery. But make it fast, as Ur cap-exemption expires in few months. (6 years from approval date)

  3. It will be consider a new application and takes around 3 to 6 months. Go for Premium Processing, U will get to know the result in 15 days
