Applying for H4 when H1 petition is filed with USCIS - 2012

Hi,

I am currently employed by a software development firm in India. My employer has filed a H1b petition with USCIS on 4th June 2012. My wife is already in US on a H1b. I would like to know if I can apply for a H4 when H1b is under processing. Are there any chances my H1b processing would be rejected. My presence in US is necessary for 2 weeks only.

I don't think there is any issue in applying H4 while H1B petition is under processing.
