October 5th USCIS H1B visa FY 2011 Cap count Update – 1,500 filed
USCIS updated the H1B cap count numbers this morning… As of Octobers 1st, 2010 the updated H1B petition filing numbers since last week are:
- New 1,000 Cap eligible H1B visa petitions were filed under regular Quota.
- New 500 cap eligible H1B petitions under Advanced degree cap.
October 1st, 2010 USCIS official H1B cap count update :
| Regular H1B Cap H1B filings | 40,600 of total 65,000 |
| Advanced degree cap filing count | 14,900 of total 20,000 |
| Total H1B visa petitions received | 55,500 of total 85,000 |
Analysis – Job Outlook weak 2014.
As we compare the H1B petitions filed last week i.e. Sep 28th, 2010 H1B visa Cap Count, the regular cap filings decreased by 300 from 1,300 to 1,000, while Advanced cap number slightly went up by 100 from 400 to 500. Overall, the total H1B petition filings went down by 200. No Ground breaking news in the last week. We are just entering the last quarter of the year, managers will be busy either trying to spend their budget or save their budget…On the other hand, they will be preparing for the next years budget proposals.
Coming to economy, today there was a news release on CNN by an elite panel of economists, including noble prize winner, saying that “ Weak jobs outlook until 2014”, which is not a very good sign for economy. There were bits and pieces of some economy news around, nothing too exciting. Slight increase in pending home sales up by 4.3% and Fed may buy back the government debt to help economy…We just have to wait and see what happens…
The interesting part is, when I talked to my cousin in India other day, he was saying there are plenty of jobs in IT filed in India and job market is in full boom…irony is, most of those IT jobs in India are created because of outsourcing to India from US, Europe and other parts of the world…

Dear Kumar,
I am on H4 to US, Before starting with my H1B processing, I had a concern about my current visa status. As I am here on H4, and my wife is about to initiate her H1 extension, I am concerned if having applied for extension would affect the my H1 filing in anyway. Please confirm and let me know if there is anything else to be taken care before starting the extension process.

Santhosh, It depends on how you are filing your H1B petition…If you are applying as a change of status, your I-94 may come into picture, thats something to consider….imagine a situation where you send the current I-94 info, but you get new H4 extension with new I-94 on it, then there might be some confusion. I am not a lawyer, just trying to think logically…If you are not applying H1B as Change of status and just general application, then I think it must be fine…Check with the attorney you are filing H1B with for additional advice.

I found following information :-
1.When H1B Extension is approved, will we get the I-94 number same as the previous I-94 number? Or will the new I-94 NUMBER is different from the previous I-94 NUMBER?
Ans:It should be the same as ur current I94 (with new start and end dates) for extn of status u wld not get a new I94 number.
2.I’m currently On H4 status and it is filed for extension along with my spouse’s H1-B.Is it legal to proceed with My H1 filing while my H4 is under extension?
Ans:There is no problem in changing status from H4 to H1B if the I-94 in connection with H4 has not yet expired. In this instance, after H1B petition has been filed, the pending H4 extension application can be withdrawn so that H4 is not approved after H1B approval. (Otherwise you will be back in H4 status after briefly being in H1B status, as you can hold only one status at a time, and the “latest action” by the USCIS determines what is your current status).
I need your help to confirm the same.
