November 30th, USCIS H1B visa FY 2011 Cap count Update – 1,987 filed
USCIS updated the H1B cap count numbers earlier today. As of November 26th, 2010 the updated H1B petition filing numbers since last week are:
- New 1,423 Cap eligible H1B visa petitions were filed under regular Quota.
- New 564 cap eligible H1B petitions under Advanced degree cap.

H1B filings up, Analysis of Economy
As we look at the H1B filings this week, there has been good movement in H1B filings trending up consistently in the last three weeks. In comparison with last week, Nov 19th, H1B Cap Count, the regular cap filings were up by around 250 petitions from 1,177 to 1,423 whereas the advanced cap filings were up by around 130 petitions from 436 to 564. It is a good sign for prospective H1B holders as this up trend suggests the need for skilled workers…We may run out the advanced degree cap in under 3 weeks or exactly three weeks if the current pace continues. If you are on OPT in US and you only have OPT period left for only few months, then you should hurry up and get things going for filing H1B petition.
If we look at the economy, the conference board published consumer confidence index today and it is up by 4.2 points, which is highest in the last 4 months. Also, in a report by Reuters, they say that the US chain stores sales including the weekend traffic to these showed gains indicating strong start to holiday spending. Analysts also speculate the unemployment to remain at 9.6 %. Except housing market, all these other signs indicate stronger positive outlook for the economic recovery. Also one of the top fed officials say that the Fed’s $600 billion stimulus will not impact the long term inflation drastically and put economy at risk…in fact, I had a economics class last fall and we studied in depth about Fed and its policies…the reality is, fed has lot of power to control the economy using the monetary policy…So, though the move of pumping $600 billion is controversial, Fed has tools to keep things like inflation in check if needed.

Hi Saurabh,
My OPT started this year July 13, and shall expire next year ’11 the same date. All this while I had been thinking of having my company apply for H1B for Oct 1, 2011 (Fiscal Yr ’12) as OPT was saving health and medicare taxes for that long. Is there any reason you see I should hurry up and apply for H1B advanced degree cap for the ongoing cap that is fast filling up?

If you apply for H1 in next year’s quota, then you need to apply it along w/ COS and w/ start of 1st Oct 2011. This way you will be eligible for cap-gap provision, and can continue to stay and work in US after your OPT has expired, but H1 hasn’t kicked in. The drawback is that you would not be allowed to leave US during the cap-gap period.
If that is not an issue, then I agree it’s much more beneficial (financially) to work as much as possible on OPT. I also doubt that there would be a lottery very early in next year’s quota.

Received RFE recently for project agreement and end client invite letter. I couldnt get the client invite letter for legal issues however managed to get one from onsite lead, member of my company. We have submitted this letter and project agreement to USCIS. Would they consider the letter??
Any problem of denial here??
I would say it is 50:50. USCIS generally needs information from the client, and they may or may not buy the letter from someone within your company. It is not possible to answer in yes or no, and it is subjective.
Does USCIS publish anywhere a count of H1b 2011 approved or rejected?
No. USCIS doesn’t make any such publication. However, past filings can be viewed on flcdatacenter.
