November 2nd, USCIS H1B visa FY 2011 Cap count Update – 1,800 filed
USCIS updated the H1B cap count numbers for this week and as of Octobers 29th, 2010 the updated H1B petition filing numbers since last week are:
- New 1,300 Cap eligible H1B visa petitions were filed under regular Quota.
- New 500 cap eligible H1B petitions under Advanced degree cap.
October 29th , 2010 USCIS official H1B cap count update :
| Regular H1B Cap H1B filings | 45,600 of total 65,000 |
| Advanced degree cap filing count | 16,700 of total 20,000 |
| Total H1B visa petitions received | 62,300 of total 85,000 |
Analysis of H1B numbers, Elections and US Economy .
The H1B filings reported this week are pretty much similar with last week, Oct 27th H1B cap count updates, The regular cap reduced by couple hundred from 1500 to 1300 where as the advanced degree cap filing volume remained at 500. The advanced degree cap is moving at a brisk pace, if the same pace continues we can have the cap reached within 6 to 7 weeks. Whereas the regular cap is still going at a relatively slow pace and we can expect it to last until early next year. Caution for MS and MBA graduates who are at the end of their OPT, file for H1B as soon as you can !
If we look at the political situation, American people are headed to polls today and it seems like GOP(Republican party) might gain more seats as they are dissatisfied with current Democratic Govt. to fix the economy crisis and unemployment. Analysts predict a gridlock, if GOP wins more seats, as Mr. Obama’s presidential term is still left for 2 years. The way this impacts us as non-immigrants is that the immigration reform that was part of the last presidential campaign may have hard time passing in the house with majority shifting.
As per the economy, there was surge in manufacturing sector orders beating the analysts expectations. It increased the employment index slightly in that sector. This has been the 11th straight month with increase in this sector and economists say we are less likely to go to double dip recession with these kind of numbers. Also, Fed is meeting to come up with new plans to boost the economy. They may plan to buy back bonds to decrease the interest rates in market encouraging home builders and other economic activity. We will know more next week.

I had a small query..
My H1B Visa got filed somewhere in the month of august and I recieved my file number from USCIS.Currently my VISA status is initial review.A few days back one of my friends told me that… I need to get my VISA stamped before 31st Dec 2010 .Is this true?
That’s not true. 31st Dec is no important date in visa process. You can go for visa stamping anytime after actual petition is approved (which can very well happen in 2011).
Just want to ask something. Republicans got into the house, how does that impact us??
Hello Kumar,
I got my H1B last September after applying in late April! I am a French citizen and I am in Canada. I will only apply for the H1B visa in May but before that I’d like to go in vacation in the US (as french we don’t need a visa).
Do you know if there will be some issues after that to get my H1B? I asked my lawyer unfortunately she doesn’t know but recommended to only go back to the us with the H1B. My employer doesn’t really care as long as I got my visa in May.

I don’t think there will be any issues. It is ok to travel to US for pleasure, and not do any work here (even when you have approved H1 petition). At the PoE (port of entry), you can clearly mention what the purpose of the trip is, and you should be all fine.
