How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. Read Step by Step Plan to Apply for H1B 2015

How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. The fundamental concept of finding a good employer does not change.  You can use our H1B Visa Sponsors Database  and search for sponsors in a city or zip code. Check out the above links under 2015 latest news and updates for the current year’s article to find sponsors. You can also, read our last year’s article :  How to find H1B Visa sponsors, avoid fraud

What would be the H1B Filing fee for Fiscal year 2015 ?

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. If you go for premium processing again that is $1225.  You can check out the detail break up of fee at : H1B Visa Filing Fee Details – Who Pays for What ?

H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

You can read Summary of CIR – Immigration reform – H1B Visa and Green Card  . We will keep you posted with updates on CIR and H1B visa changes for this year, if any. Did I miss anything ?  Do you have any other questions ?

The blue handout is given to the candidates from whom additional
documents are required. When you have the required documents, either from the petitioner, from you,

Some applicants have received a white form at Chennai for 221(g) refusal. Contents
of this form are exactly the same as the blue form. There is no apparent difference. It appears the form
is printed on a different color, but means the same thing.

U.S. Embassy, New Delhi

After your interview, if you were found temporarily ineligible
for a visa under section 221(g), you would be given either a green, yellow, or pink instruction sheet.

Hi guys,

I’ll be going to the H1-B VISA Interview this week and some questions came up and I wanted to know if someone could help me clarify (please provide source where you got the information from if possible):

1. My Passport will expire on July 2016 but the document it says that the H1-B will be valid until Oct 2017, Would this be OK to go for the interview or do I HAVE to issue a new passport?

2. My initial salary will be 56k in NYC and I’ll be going for the interview with my wife (H4). I was wondering if this could be an issue since it’s a relatively low income.

Thanks a lot!

Reply

Indiguy September 1, 2014 at 4:12 am

1) You are OK, no need to worry about passport expiry as of now. You won’t get a new passport because there is 10 more months for it’s expiry.
2) Just tell the truth i.e. 56k. It’s VO’s discretion to determine whether to grant visa or not. No one can do anything on that.

All the best.

Jeremias September 1, 2014 at 11:16 am

Thanks a lot for the reply!

I just checked with some companies specialized in H1-B and you’re right.

About the salary, I’m aware that the value is at least the minimum allowed in NY state and I also got some money in my bank account. I was really just wondering if they would be like: – “I’m sorry, you cannot afford both of you with THIS salary. Denied!” even though I lived in NYC previously and know that it is possible. Probably just me worrying too much.

Iam going stamping sep 9.
My wife still does not have passport and our kid is 1.5 month old. Even my kid does not have passport. My wife and kid planning to travel next year April. I heard that its recommended that it is preferable to take them along with me for stamping. But now if i apply passport for them it will take atleast 1.5/2 month for getting passport for my wife and kid. Want to check if i will have any issues if i go alone for stamping OR if my wife/kid go for stamping alone in next year April.

Reply

Vijay August 31, 2014 at 9:05 pm

It is an added advantage to go along with the family. Getting a new passport is easier these days.

You can get the passport for your wife and kid in even 5 days in tatkal. You just have to try.

Hi,
I have a question regarding my rfe. I am from Sullivan university and work on my CPT from them. I was applied for my H1B visa through a consultancy. First my employer got an RFE regarding the client letter and then once I replied back we got one more regarding my CPT and educational details. Now my employer is not responding my RFE to USCIS. I have the receipt no on me. Now my question is whether I would be able to respond my RFE through an attorney other than my employers attorney or not. I will really appreciate any suggestions…

Reply

Indiguy September 1, 2014 at 11:21 am

Your employer’s attorney is the person should be replying. H1-B is tied to an employer and it is his responsibility to take care of such situation. But, you should explore other options if there is one, talk to an attorney and see what he says.

Could you guys please suggest on the same.

Thanks in Advance

A WelWisher August 31, 2014 at 12:34 pm

You can apply for your spouse before you go to US. I have seen many of my friends traveling US on H1 along with spouses. So, check with your employer and apply for stamping date of your spouse’s H4.

Reply

Indiguy September 1, 2014 at 4:20 am

You can apply for your spouse visa anytime i.e. either along with your interview or at a later time. There is no requirement for H4, make sure she carries marriage cert and photos during during.

I am trying to pay for visa stamping fees, but when I go to the payment page I see a very strange thing. Its tells exchange rate to be 1 INR = 1 USD and asks for a payment for 190 INR. Few days back it was correct, showing 62 INR = 1 USD and also showed a validity period for this exchange rate. I dont know what is wrong with the website. Also the visa fee info page:http://www.ustraveldocs.com/in/in-niv-visafeeinfo.asp showing incorrect information(open page->scroll down->look for excahnge rate).
Anyone facing similar issue? Any one contacted customer care?

Reply

Indiguy September 1, 2014 at 4:22 am

You take the payment page to the bank and they will charge you the correct fee amount. No need to worry about what is being displayed in the system, it is an error.

Hey All!!!

I got my Soft copy of i797 document, in which they have mentioned that consulate as Hyderabad, so I was wondering if I can change the location because I heard visa success rate in Hyderabad is less when compared to chennai and Mumbai, please advise on the same. Any one who have attended visa interview in Hyderabad, if yes please share your experience.

It is very important for me to get visa stamping done, please help

Have you seen any H1 with approved petition got rejected? I think, H1 B rejection is very minimal unless they really see an issue that could not be caught during initial approval screening process.

Pay online and take a print out of same.. (A printable Copy)

Hi,

I got my petition approved this year. Now, I work for a big MNC and they didn’t reveal the receipt number yet. I don’t have a valid US assignment yet, will get probably in March. I havn’t received any documents till date, just the approval email. Now, I’ve got a really good offer in another company. Any way I can switch and keep my VISA ? I have heard if I leave the company, they withdraw the petition, any way I can re apply with Cap exemption ?

Does it make any difference in such situation if I know my petition receipt number ?

I believe an H1B transfer can take place only when you’re in the US. So, you will have to get the visa stamped on your passport based on the current sponsored petition, travel to the US, and then get the visa transferred to the new employer. Your first employer does not need to be informed when you’re making this change. However, you cannot change jobs before that.

My question is here the status is still showing as “Your case is open and ready for your interview, fingerprints, and required documents. If you have already had your interview, please check your status after two business days” how many days will take to get the status as issued passport status as still with us consulate/embassy

good to worry a little

I think RFE response time is around 90 days ( some say it’s 78 days) — exact is written on notice received by employer

hopefully your employer will file in the meantime , as he has the duty and experience

There is nothing gonna change as you worry. You did your part. Now if it will be in your destiny to be there in US, you will be. Else, there would be some good sign behind the other thing.

Don’t worry for things where you don’t have control.. :)
