How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. Read Step by Step Plan to Apply for H1B 2015

How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. The fundamental concept of finding a good employer does not change.  You can use our H1B Visa Sponsors Database  and search for sponsors in a city or zip code. Check out the above links under 2015 latest news and updates for the current year’s article to find sponsors. You can also, read our last year’s article :  How to find H1B Visa sponsors, avoid fraud

What would be the H1B Filing fee for Fiscal year 2015 ?

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. If you go for premium processing again that is $1225.  You can check out the detail break up of fee at : H1B Visa Filing Fee Details – Who Pays for What ?

H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

You can read Summary of CIR – Immigration reform – H1B Visa and Green Card  . We will keep you posted with updates on CIR and H1B visa changes for this year, if any. Did I miss anything ?  Do you have any other questions ?

I have question on the I94. My petition is approved but when I check my I94 online it is still not updated to H1. What could be the reason for this. I never travelled anywhere outside the country during the complete H1 process cycle. Kindly advise

H1B Visa October 30, 2014 at 11:24 am

Hi ,

My Employer told me that ” petition is approved recently , and unfortunately USCIS is not announced any definite period to dispatch the approved petition.”

I think petition is approved longtime back, but employer is not disclosing the date.
Could you please let me know
1.how many days USCIS will take to dispatch petition.
2. how many days will take to reach me

Suraj October 30, 2014 at 1:18 am

Hi All,
Can anyone please advise if dependent have to undergo medical test for H4 visa stamping.

Thanks in advance!

SSingh October 30, 2014 at 10:37 am

if you are asking about one test which screens for TB, polio etc then yes dependents also have to go through it. Info is based on my experience while employed with Big MNC in india.

H1B October 30, 2014 at 1:52 pm

It is required during travel to US. But not for stamping.

Hope October 30, 2014 at 1:41 pm

No, I didnt submit any medical certificate and I neither took health test for my H4 visa. You can check with your Company HR.

H1b Denied October 29, 2014 at 11:15 pm

I am a silent follower of this group and want to know if once visa denied, can I reappealed and if yes, what is the chances of getting approval ??

Akash October 30, 2014 at 12:06 am

My H1B was also denied on 27th October. Please advise on the chances of getting approval after reappealing and the duration of processing?

H1B October 30, 2014 at 1:58 pm

If your petition is denied, you can appeal. The success is based on the reason for denial and how well attorney handles. But overall general success rate is 20%. The processing time is usually 6 months, but few cases even take up to 1.5yrs.

Optimistic Jack October 30, 2014 at 3:09 pm

To H1B:

we don’t know about the facts and your source “overall general success rate is 20%. The processing time is usually 6 months, but few cases even take up to 1.5yrs.” DON’T BLABBER just for the sake of replying. You must be aware many are following this forum for correct and realistic data.

H1B October 30, 2014 at 3:38 pm

I am not sitting idle to just blabber. When I needed this info..I didn’t get it easily. After checking with many consultancies and attorney I got this info. I have also mentioned each case is different.

Don’t be rude on public forum…if you are sure the info is wrong then post the correct info which you know instead of blaming others.

H1Denied October 30, 2014 at 3:35 am

Mine H1 also denied on 29 Oct. Can anyone please suggest for next steps and are there any chances of approval?

vb October 30, 2014 at 4:56 am

Any specific reason for denial?

SSingh October 30, 2014 at 10:35 am

you guys are talking about Visa denial after approved H1B petition or H1B petition denial itself . I see two things in your questions ?

swetha October 30, 2014 at 10:30 am

About the denial , if you feel you have submitted everything then we can go for Motion to Reopen (MTR)the case within 30 days of Denial.

H1b Worried October 30, 2014 at 12:30 pm

Can u plz let us know the reasons for denial ??

Hope October 30, 2014 at 3:49 pm

yes, you can reappeal if you feel the reason is not valid. All the best! Let the lord help you to get it approved for you.

Still in RFE EE October 29, 2014 at 12:15 pm

Hi ,

My RFE was responded on Aug 22 .
Location :California
RFE: Educational Evaluation and employer company proofs(tax returns etc etc)
Its been more than 60 days by now and I’m worried about the result . Please share your views?

Thanks in Advance

shi October 29, 2014 at 9:27 pm

you are not alone. California center is just a bit slower. Again, 60 days is no guarantee but an estimated processing time.

Bond October 29, 2014 at 11:04 pm

Mine is RFE RR since Aug 18. Its California center. No updates yet…. :-(

srini October 29, 2014 at 7:15 am

Hi experts,

could you please help with my situtation below.

my h1b is approved the company A and currently im working for company B in india.
now company A is telling me to submit ds 160 form with current company as company B and filing company as company A.

will this work when i go for stamping? as im directly joining company A in US.(company A is having branch in india).

SS October 29, 2014 at 7:40 am

yes srini…thats the process…u r good to go…

SSingh October 29, 2014 at 9:47 am

yes, that’s fine, because approved H1B petition means you have a new job offer from company A in USA. as to work in USA you need a work permit so company A has applied for work visa (H1B) for you.
If you see most of the big MNCs have their subsidiaries in USA and when they send ppl to USA on H1B they give new offer letter from their subsidiary company. That subsidiary company has its independent entity in USA as a company. just the owner company of that subsidiary happens to be the big MNC. you are good to go if you have all documents and answers for visa officers questions;

srini October 30, 2014 at 12:53 am

thanks SS, SSingh

LCA query October 29, 2014 at 6:24 am

Hi All,
Im hearing lots of rumours about new LCA rule. Can someone explain what exactly has changed.

Im planning to apply for LCA change(change in client) this week after I got my visa stamped last week. Can someone advice if the new rule will have any impact on my LCA change. The duration for LCA change communicated to me was 10 working days, will it change as per new rule.

SSingh October 29, 2014 at 9:52 am

If your company follow all rules then LCA change requires amendment to H1B petition which is more or less same thing applying for a H1B extension. company prepares a new petition , new job role for you, new client etc etc just you happen to be a cap exempt now.
Till now most companies don’t bother to file amendments just to change LCA but in last few years big MNCs have started to follow this practice which is in fact required by USA law. I guess your H1B holder is a big MNC.

LCA query October 30, 2014 at 3:13 am

Hi Singh,
My company just informed me that only 10 working days is required to change my LCA. My company is a top 5 MNC.

SSingh October 30, 2014 at 10:24 am

if they said only ten working days that means they are just getting new LCA. and not filing amendment. as I mentioned in my previous response most of the companies dont bother to file amendment and just file for revised LCA. main reason is the process to file amendment is long and takes time. and has same risk of approval/denial/RFE as any other H1B extension petition.

as you are with top 5 mnc and most of the time they have good legal team to advice you are in good hands.
New LCA just takes from 5-10 working days and no complications in the process. you already have your visa stamped.
One more advice : your H1B petition and Visa records has client A name but your new LCA is going to have new client B name. as such by rules it is a case of H1B amendment so act smart if any immigration officer inquires you about at port of entry. I hope your client A and client B both are in same location ( City). better be prepared with your answer. The most frequent question asked by immigration officer at port of entry is “what is your client name and where you are going to work”. you are from top mnc so just stay confident and act smart…god luck with your travel

LCA OR AMEND October 30, 2014 at 10:57 am

yea even I am in same situation. I am with one of Big 5.Will travelling with just a new lca be a problem at port of entry? … as that seems to be the norm so far in the history.but this year attorneys are pushing for many amendments but thats just random. they want to file some amendments to show up numbers.

Hope October 28, 2014 at 9:20 am

I just checked the processing time for Vermonth in the USCIS site for H1B COS and gives :

Rohit October 27, 2014 at 10:27 am

My petition is still in RFE RR since 15 Sep. Not sure how many more days to wait. Is there a deadline to have all the petition for 2015 completed?

Hope October 27, 2014 at 10:38 am

I am waiting from AUG 18th :(

h1bwaiting-REF-RR October 27, 2014 at 11:30 am

Im waiting from Aug 11th. RFE RR. Califotnia center.
As per my lawyer this center is bit slow when compared with vermount.
And told me that by this month end we can expect all approvals.
Hope for the best.

@california center October 27, 2014 at 11:45 am

RFERR :: Sep 11th still waiting.
California center,
hopefully all RFEs should be taken care of by this month end or Nov end coz they will be busy whole december.
Keep up the hopes guys :)

Hope October 27, 2014 at 12:34 pm

My H1B was filed at the Vermont but still I am waiting from Aug 18th. It is too much waiting :(

Bond October 27, 2014 at 8:33 pm

Mine is also in RFE RR since aug 18. :-(

h1bwaiting-REF-RR October 27, 2014 at 10:24 pm

You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use the processing time information on our website to estimate when this case will be done.

That is what site says regd the time line for RFE RR.

Hope October 28, 2014 at 9:11 am

Yes, it says 60 days which is their estimated time but they didnt promise it will be exactly 60 days. I have seen pple getting H1B approved in December and January last year. We never know how long they will take :( If it goes to December well it will again get delayed due to Christmas, Newyear holidays. Pple take long holidays during those time. All I could wish is we all should get our visa’s approved by this month end. Praise the Lord!

Hope October 28, 2014 at 9:12 am

We are on the same boat Bond :D Let’s hope ours get approved very soon. Let our lord help us :D

SaiRaghava October 28, 2014 at 9:44 am

TCS_H1B_Blr October 27, 2014 at 5:49 am

Hi ,

Anyone got update on RFE ?

TCSer October 27, 2014 at 7:06 am

No, Still the same status .. submitted RFE on AUG end to FDFU…

rfe waiting October 27, 2014 at 1:18 pm

No updates. Submitted docs by July 3rd. Still waiting

tcs rfe approved October 28, 2014 at 2:50 pm

Finally got my petition approval mail today.. feeling very happy. . It’s been indeed very long journey for me. Failing in lottery last year and finally everything is for this good.. wish all of the folks waiting to get their updates soon..
Just curious whether anyone knows available dates in Nov. In chennai consulate.

Rfe June 3rd
Rfe deadline date July 27
Approved per uscis site 19th Aug.
But i am notified only today, Oct 28. Not sure where it’s delayed.

TCS_H1B_Blr October 29, 2014 at 4:36 am

I dropped a mail to chennai visa center . They replied saying that “we wil update once we get response from uscis ,no need to follow up from ur end ” …:(

TCSer October 29, 2014 at 5:59 am

Finally my petition also got approved . but I have not got the petition number , they said as per rules “untill they receive the petition in hand , cannot disclose the receipt number” .

I need to check when petition is approved and for how many years.

Need to wait for some more time :( to know these things.

TCS_H1 October 29, 2014 at 7:34 am

What was your rfe docs submission date

h1b October 29, 2014 at 5:43 am

I think you have dates from second – third week of November. Since your visa was approved on Aug 19th, your docs would have already reached TCS well in advance, and you might be able to book the slots asap.

My only advice – carry an umbrella + transparent file to carry all the docs + a bottle of water(in case you need..its gonna take hell lot of time to get in)

Try to book a slot which is very early in the day like 8 or 8:30 so that you don’t have to wait much .

Don’t carry mobile phones + bags as its a headache to manage it with locker, and also carry very less stuffs in your wallet.

TCSer October 29, 2014 at 6:01 am

Did you receive hard copy of petition?

TCS_H1B_Blr October 29, 2014 at 7:26 am

Hi TCSer ,

When u have submitted the docs ? . I am not getting any response from chennai visa cell tcs . I am very much worried :(

TCSer October 29, 2014 at 7:53 am

I Submitted RFE docs on Sept 7th . Take your account manager’s help and check the status with visa team , then only you will get to know the status . Otherwise wait for official mail ( they will send once after hard copy reached to Chennai)

TCS_H1B_Blr October 29, 2014 at 8:09 am

Hi TCSer ,

When u have submitted the docs ? ..I have also submitted in august end . But no response from chennai . I am very much worried:(

TCS-VisaStatus? October 29, 2014 at 6:06 pm

My petition gone through the lottery but I am still waiting for my visa status?

vb October 27, 2014 at 3:24 am

Hi every one,

My petition is approved and i am planning to attend visa interview for me and my wife.
My worry is , my wife also currently employed on same company, if she attend with me as dependent, It wont be a problem? Employed spouse is eligible for dependent visa, Pls pls suggest.

RMM October 27, 2014 at 4:20 am

Yes She is Eligible for H4, However she can not work in US..

vb October 27, 2014 at 4:58 am

Thank u very much RMM. So, not required to resign her job, while attending the visa interview? we can convey to VO as, currently she is working, she will resign while going to US, am i correct? sorry little bit worried :)

Latif yahia October 27, 2014 at 5:54 am

You can say that, your wife is working here and has some professional commitments. She will join with you once her assignments gets completed.

H4 stamping is a cakewalk., can be done very smoother.
Her employment will not be a problem

RMM October 27, 2014 at 6:25 am

Latif is Absolutely Right !!!

Hope October 27, 2014 at 9:28 am

You can mention that she will either resign or will be on long leave but better stick to resigning the job. I actually gave my resignation letter but still the VO questioned me if I will be working in US or interested to in the future. I replied “No” and got my visa :D

VB October 27, 2014 at 10:58 am

Thank you very much latifyahia/RMM & Hope.

Yours answers really helped me a lot.. Appreciated. My wishes :)

Rakesh12345 October 27, 2014 at 3:10 am

Hi friends,

My petition was filed for client but my work location is at employer’s place.i have the following docs.
Employer and client agreement
Project document.
1)is it required to have client letter since i work at my employer location ?
2)if VO ask for client letter how can i manager ?

your suggestion will be highly appreciated.

H1B Seeker October 27, 2014 at 2:08 am

Yes you need to pay for dependents also.

Same amount for all (H1 / H4)

All the Best

MAHESH October 27, 2014 at 7:55 am

Hi All ,

SO just to reconfirm
my h1b visa fees = 190 $
my wife h4 visa fees = 190 $
Total = 380 $ for both.

One more question , I am employed and going to work for a diffrent employer in USA ,
Would i be asked for current company resignation letter ? and if i say Not yet resigned how would i deal with situation at the time of interview ?
Would i be asked ‘when you are planing to fly ‘ , as i have not made any plans yet ?
would i be asked my itinery as well for flying to USA ?

Sorry to Bother all , just want to be double sure :) …..

SSingh October 29, 2014 at 10:01 am

‘when you are planing to fly ‘ ?
you have already answered this question while completing DS160. stick to same answer. if in DS160 you have mentioned specific travel plan then arrange for some itinerary its better.otherwise you are good.
Resignation letter : Again it depends on what travel plan you have mentioned in DS160. if you have mentioned that you are planing to travel after 1 week of visa stamping then it is assumed that you have resigned from company by now. generally no visa officer asks for resignation letter but when he inquires on this topic u should sound strong and clear on this topic.

Visa Fee October 26, 2014 at 12:04 pm

Petition Approved on Oct-17th.. waiting for doc’s from employer to schedule visa interview.. can you plz let me know how much VISA FEE ? .. *****

Prasad October 27, 2014 at 12:08 am

It will be around 12KRs.

RMM October 27, 2014 at 12:11 am

190 USD = 11780 INR

MAHESH October 27, 2014 at 2:06 am

Is it only for h1b worker…..how about if interview is accompanied with dependents….
if you wish to accompany your wife for h4 , do we need to pay more amount other than 190USD ?

RMM October 27, 2014 at 4:22 am

Bharani October 28, 2014 at 1:34 am

Hi Mahesh,

For each stamping (each person)you need to pay $190. Either it is H1 or H4 or dropbox.

Mine was employee employer relationship rfe. Employer did Not submit Client letter will it have any impact

H1 Denied ? Dont worry October 27, 2014 at 10:22 am

Hey Guys,

I am tracking the few tens of random numbers (all WAC** ) as mine is too in wait exactly same situation as many of you… during everyday status check, i am finding 50:50 approved and denials. It looks like USCIS found a new way of squeezing the lil more amount, buying more time as well as asking so called necessary papers by encouraging to file the MTR process.. This is an excellent excuse for another RFE if you already have one.. so the crux of the matter is don’t loose hopes even if you got negative news. This may be hard to digest for many but seems a reality…

Best luck :)

221GStatus October 25, 2014 at 4:15 am

I was attended interview on 09/26 and I got 221g blue form(administrative processing)
How many days it will take to process?

Kalinga Singha October 25, 2014 at 8:31 am

Hello, Was it for a fresh H-1B or Change of Status?

221GStatus October 25, 2014 at 9:18 pm

fresh H-1B.

SSingh October 29, 2014 at 10:05 am

have they asked you to submit any documents ? then submit the documents and wait.
if they have not asked you to submit any documents then gen it takes 6-8 weeks. Admin processing is very tricky thing as you cannot track the progress of your case so just be patient and wait.

Hope someone can help me providing some information.
I was in L-1B status since 2010 and from this October 1st I got the status changed to H-1B, and I’m working for the same employer.
They missed to file COS for my spouse from L-2 to H-4, we have applied I-539 for her COS, and the case is pending.

We are planning on travelling to India in December, and I think I’ll need to apply for a new H-1B visa stamp at the US consulate in India before re-entering to US.
My question is – do we see any rejection in the L-1B to H-1B COS visa stamping? And if they do, which will be unfortunate, but what would be the way to re-enter the US?
I think my previous L-1B is no more valid since I got a new status, H-1B starting from October 1st.

Any information/experience anybody could share will be greatly appreciated.

Thank you very much in advance.

SSingh October 29, 2014 at 10:10 am

Gen no issues in this as you are with same employer, have past pay slips, W2 etc. I saw many of my friends got visa stamped in this way from L1 to H1. sometime they ask a tricky question about your position and skill set because last time you had skill set and job that qualifies for L1 and now same job/skill set is qualifying for H1 visa. that’s a tricky thing as L1 and H1 skill and job requirements are quite different.i hope you got my point. so just prepare the answer that how you evolved in your present job/role to move to new role/job.

Can I make Visa fee payment without filling DS-160 form first?
Becos I done payment first without filling DS-160 form..
Please reply early please…..

Latif Yahia October 25, 2014 at 8:53 am

Yes. You can do VISA payment without completing DS160
But atleast you should have DS160 application ID (I,e should start fiing DS160) before you book interview slot

Make sure you finish DS160 filling before going to interview

H1H4interview October 27, 2014 at 10:33 am

Thanks alot Latif..i just clarified with some others also.
What you said is absolutely CORRECT
..thanks for your help.

H1H4interview October 27, 2014 at 10:40 am

In DS-160 form:
Intended date of travel means? can we fill 1 month from now?

where do you stay in US?
can we fill employer address in US? or any hotel name?

Do we have any mention about H4 dependent on LCA/129/797 docs?
My question is: do we have to mentioned about dependents in petition while filing H1B?

SS October 24, 2014 at 11:33 am

Question regarding visa date less than petition date.

Hi all,

My visa date is given almost 9 months less than petition date..is there a chance for correction…if possible how much time does it take?

thanks in advance.

SSingh October 27, 2014 at 9:34 am

I dont think their is any way, and visa duration is totally dependent on visa officer. so this is not a mistake, its visa officers’ decision.
later on you can file for visa extension for nine months using same petition .

SS October 28, 2014 at 11:19 am

Thankyou SSingh…

H1H4interview October 24, 2014 at 10:54 am

H1H4interview October 24, 2014 at 12:25 pm
