Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

Any one tried paying the stamping fees over the weekend? I see a strange thing current consular exchange rate is 1 INR = 1 USD, not sure whether to make the payment or not?

Hi,
I have a question regarding my rfe. I am from Sullivan university and work on my CPT from them. I was applied for my H1B visa through a consultancy. First my employer got an RFE regarding the client letter and then once I replied back we got one more regarding my CPT and educational details. Now my employer is not responding my RFE to USCIS. I have the receipt no on me. Now my question is whether I would be able to respond my RFE through an attorney other than my employers attorney or not. I will really appreciate any suggestions…

Hi ,
I have attended the interview on July 22nd and visa stamping was done on 26th August.During the time of my interview my spouse passport is in process .Now I would like to apply H4 for my spouse.Can i do this now or do i need to travel to U.S first and then apply h4 for my spouse by sending the pay-stubs. Could you guys please suggest on the same.

Hey All!!!

I got my Soft copy of i797 document, in which they have mentioned that consulate as Hyderabad, so I was wondering if I can change the location because I heard visa success rate in Hyderabad is less when compared to chennai and Mumbai, please advise on the same. Any one who have attended visa interview in Hyderabad, if yes please share your experience.

It is very important for me to get visa stamping done, please help

Still waiting on approval details. Is it normal to wait this long, it’s gone past 60days. Some people said no need to ask employer for change to PP at this time. Receipt no EAC14144.. Any suggestion??

My petition is approved and got documents from my employer. I need to submit DS 160 form before stamping. Can you please help me to know where I should get DS160 form? Do I need to fill it online or I have to download form and then I should fill it manually.

Fill online. Keep saving in between as it is too long and likely to expire you session.

Pay online and take a print out of same.. (A printable Copy)

Hi,

I got my petition approved this year. Now, I work for a big MNC and they didn’t reveal the receipt number yet. I don’t have a valid US assignment yet, will get probably in March. I havn’t received any documents till date, just the approval email. Now, I’ve got a really good offer in another company. Any way I can switch and keep my VISA ? I have heard if I leave the company, they withdraw the petition, any way I can re apply with Cap exemption ?

Does it make any difference in such situation if I know my petition receipt number ?

I believe an H1B transfer can take place only when you’re in the US. So, you will have to get the visa stamped on your passport based on the current sponsored petition, travel to the US, and then get the visa transferred to the new employer. Your first employer does not need to be informed when you’re making this change. However, you cannot change jobs before that.

I have attended h1b interview on August7th,i have verified in site its showing administrative processing till yesterday,
Today status got changed to ISSUED,the below matter is displayed”Your visa is in final processing. If you have not received it
in more than 10 working days, please see the webpage for contact information of the embassy or consulate where you
submitted your application”

my question is whether my visa got issued or not ? please let me know friends.

Initial:10 April 2014
RFE:18 July 2014
RFE Responded: 1st August 2014
RFE Response Review:25th August 2014 (Note here, although docs were sent on 1st aug, USCIS updated that we received docs on 21st August)
Approved:28th Aug 2014

I think RFE response time is around 90 days ( some say it’s 78 days) — exact is written on notice received by employer

hopefully your employer will file in the meantime , as he has the duty and experience
